(MFP)

Mediation is a process “whereby parties request a third person or persons (the mediator) to assist them in their attempt to reach an amicable settlement of their dispute arising out of or relating to a contractual or legal relationship.” It is a consensual and confidential process conducted on a “without prejudice” basis, in which the mediator will deploy special skills to help parties resolve issues of mutual concerns. It usually produces a more satisfactory outcome than adjudicative processes with less cost and time.

The MFP is a statement of policy for encouraging corporations to use mediation as a means to resolve business-related disputes. It promotes early dispute resolution and establishes a framework for initiating the mediation process to resolve conflicts in amicable and constructive manners. It also helps control risks and expenditures of time and money by removing stumbling blocks of convening mediation. MFP provides a platform for companies to demonstrate support to use amicable ways to resolve conflicts.
